What is a “Subject To” Transaction?
A “Subject To” transaction in real estate refers to a method where a buyer takes over the seller’s existing mortgage payments without formally assuming the loan. The existing loan remains in the seller’s name, but the buyer agrees to make the monthly payments. Here’s a breakdown of how it works:

- Agreement: The buyer and seller agree that the buyer will take over the mortgage payments.
- Title Transfer: The title to the property is transferred to the buyer, but the mortgage remains in the seller’s name.
- Payments: The buyer makes the mortgage payments, although the seller is still legally responsible for the loan.
